Determination of Applicability and Order of Conditions

Determination of Applicability and Order of Conditions

Pursuant to the Massachusetts Wetlands Protection Act, the Town of Wayland regulates activities in wetlands and buffer zones under Waylands Wetlands and Water Resources Bylaw Chapter 194. If the applicability of the bylaw is uncertain, a Determination of Applicability may be requested from the Conservation Commission (ConCom). A permit application, or Notice of Intent (NOI), must be filed with the ConCom prior to conducting any work. Upon review of the application and proposed activities, the ConCom may request changes to the scope of work or determine additional conditions the applicant must follow for the protection of the wetlands. Additional conditions are set forth in the Order of Conditions presented by the ConCom to the applicant.
